CCR Provides Pro Se Materials for Haitians in Post-Final Order of Removal Detention

The Center for Constitutional Rights, with assistance from the ACLU's Immigrants' Rights Project, has developed a packet of pro se materials for Haitians in post-final order of removal detention. The materials are intended to facilitate their immediate release and to help avoid potentially immigration detention as a result of the January 12, 2010 earthquake.

The packet guides detainees through a two-step process involving a request to ICE for a custody review, as well as a pro se habeas petition that they should then file if they do not receive the custody review within 10 days.  Also included in the packet is an instruction and information letter for the detainee, fill-in-the-blank documents and supplemental materials. This pro se packet was created to help community members and legal organizations to adapt in representing clients or to provide to detainees pro se.

Please feel free to circulate these materials and keep CCR informed of the responses and trends for release (or failure to release) in your area.

CCR is also developing arguments for Haitians without final orders of removal; however, the same forms may not be available because of resource constraints. CCR may be able to provide research on relevant arguments.
